Terms & Conditions

These Terms & Conditions apply to the use of the IVspiration Art website and, where applicable, to enquiries, commissions and purchases made directly from IVspiration Art.

IVspiration Art is operated by Hashbook LTD, Bulgaria.

About IVspiration Art

IVspiration Art creates original contemporary artworks, including one-of-one hand-embroidered works on transparent tulle.

Some artworks are available as completed original works, while others are created individually on commission.

The website primarily functions as an artist portfolio and point of contact. Unless expressly stated otherwise, purchases and commissions are arranged individually rather than through an automated online checkout.

Artwork Enquiries and Commissions

Submitting an enquiry does not constitute a confirmed commission.

Each commissioned work is discussed individually with the client. Before work begins, the parties may agree on matters including:

the subject and artistic concept; approximate dimensions; colour direction; presentation and framing; intended interior or placement; estimated completion time; price; delivery arrangements; and any other relevant specifications.

A commission becomes confirmed once the agreed advance payment has been received, unless otherwise agreed in writing.

Artistic Interpretation

Each IVspiration Art work is created by hand and reflects the artist’s individual artistic language and interpretation.

Before work begins on a commissioned piece, the client receives and approves the agreed concept or preliminary sketch, colour direction and other principal specifications.

Once the concept has been approved and creation has begun, the artwork develops through the artist’s creative process.

The commission does not include a right to request unlimited alterations or revisions to the completed artwork.

Minor variations, irregularities and characteristics resulting from hand embroidery, thread, transparent tulle and other materials are inherent to the work and form part of its individual character.

Commission Pricing

Every commissioned artwork is priced individually.

Pricing may depend on factors including size, complexity, materials, framing, level of detail, requested completion date and other project-specific requirements.

Requests requiring priority production or a shorter-than-standard timeframe may be subject to different pricing and are accepted only where the artist’s existing schedule permits.

Payment for Commissioned Works

Unless otherwise agreed in writing, commissioned works require:

50% advance payment to confirm the commission; and
50% remaining balance upon completion.

The remaining balance and delivery arrangements will be agreed individually with the client.

Where agreed, payment may be made by bank transfer. Payment information is provided privately and is not published on the website.

An invoice may be issued where applicable.

Cancellation of Commissioned Works

If a client cancels a commission before work on the artwork has begun, the advance payment may be refunded.

Once creation of a personalised commissioned artwork has begun, the advance payment becomes non-refundable.

Commissioned works created according to a client’s individual specifications or clearly personalised for that client may fall within the statutory exception to the standard right of withdrawal applicable to distance purchases.

Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.

Completed Original Artworks

For an original artwork that already exists and has not been created or personalised specifically for the purchaser, payment is generally due in full before dispatch unless otherwise agreed.

Any statutory consumer rights applicable to such purchases remain unaffected.

Completion Times

Creation times are agreed individually.

Because each artwork is made entirely by hand, completion may require several weeks or months depending on its dimensions, complexity and the artist’s existing commission schedule.

Any estimated completion date will be communicated before the commission is confirmed.

Where circumstances outside the artist’s reasonable control affect the schedule, the client will be informed as soon as reasonably possible.

Intellectual Property & Copyright

Purchasing an original artwork transfers ownership of the physical artwork only.

Unless expressly agreed otherwise in writing, all copyright and intellectual property rights in the artwork remain with the artist and/or applicable rights holder.

This includes, where legally applicable, the right to photograph, reproduce, publish, exhibit, communicate and otherwise use images of the artwork for purposes including:

the IVspiration Art website and portfolio; social media; exhibitions; publications; press and editorial material; promotional materials; artist archives; and reproductions, prints or other authorised editions.

The purchaser may not commercially reproduce, manufacture, license, distribute or exploit the artwork or its image without prior written permission.

For commissioned portraits and other highly personal works, IVspiration Art will exercise reasonable sensitivity regarding the publication and commercial reproduction of personal imagery. Any separate limitations agreed with the client should be confirmed in writing before the commission begins.

Website Content

Unless otherwise indicated, artwork images, photographs, texts, graphics, branding and other original content appearing on the IVspiration Art website are protected by applicable intellectual property laws.

They may not be copied, reproduced, distributed, modified or used commercially without prior written permission.

Sharing links to publicly available pages or appropriately crediting IVspiration Art on social media is welcome.

Colour and Digital Representation

Every effort is made to represent artworks accurately online.

However, colours, texture, transparency, scale, shadows and fine embroidery details may appear differently depending on photography, lighting, screens and devices.

In particular, works created on transparent tulle interact with light, architecture and their surroundings and may therefore appear different in person from a two-dimensional digital image.

Governing Law

These Terms are governed by the applicable laws of the Republic of Bulgaria, without prejudice to any mandatory consumer protections that may apply to customers residing in other jurisdictions.
